Habib and Treasury Board (Veterans Affairs Canada)

Before: B. Turner
Appearances: S. Waller, for the Grievor; M. Paré, for the Employer
Decision rendered: May 14, 1996

Subject terms:

Demotion - Incompetence - employer demoted grievor for his inability to meet the requirements of his position and, in particular, for his poor performance in applying policies and regulations and in supervising staff - evidence established that employer made significant efforts to provide training and coaching to the grievor and that grievor was aware of what employer required of him - however, grievor failed to put into practice what training he had received and was incapable of demonstrating the skills required of a supervisor - grievor did not call any evidence to refute this - adjudicator concluded that employer's decision to demote him was appropriate under the circumstances.

Grievance denied.
